RESOLUTION NUMBER 1 20-2023 RESOLUTION OF THE CITY COMMISSION OF THE CITY OF STEWART AUTHORIZING THE MAYOR TO SIGN AN INTER LOCAL AGREEMENT WITH MARTIN COUNTY, PROVIDING THE RESPONSIBILITIES OF THE PARTIES IN THE EVENT. A PASSENGER RAIL STATION IS CONSTRUCTED ON FLAGLER AVENUE. PROVIDING AN EFFECTIVE DATE AND FOR OTHER PURPOSES. I'M GONNA BE HANDLING THIS MATTER, UM TOM, THE OTHER HAND FROM THE TREASURE COAST REGIONAL PLANNING COUNCILORS, ALSO HERE TO ANSWER QUESTIONS. IF ANYBODY HAS ANY UM , I WASN'T GONNA GO INTO THE HISTORY BUT I THINK I FEEL LIKE I FEEL COMPELLED TO GO BACK A LITTLE. I WAS BORN IN THE SIXTIES AND MIAMI. NO I'LL BRING IT MORE FORWARD THAN THAT. UM. UH IT'S AS LONG AS I CAN REMEMBER. UH THE RETURN OF PASSENGER RAIL TO THE CITY OF STEWART HAS BEEN A PRIORITY IN A GOAL OF THE CITY COMMISSION. WHEN THE, UM. CITY WAS IN THE PROCESS OF HIRING WANI, TOO.

REWRITE THE CITY CODES JUST AFTER THE MALL HAD OPENED, AND THEY WERE, UM REDESIGNING WHATEVER ENDED UP BEING OUR URBAN OVERLAY. CODES THE CITY ALSO ADOPTED, UM COMPREHENSIVE PLAN LANGUAGE. IT WAS ROUGHLY 1995 OR 1996, WHICH IS THE SAME YEAR THAT THE BIG ROOSEVELT BRIDGE OPENED. UM TO, UH. PRIORITIZE AND FIND WAYS TO RESTORE PASSENGER RAIL TO THE CITY OF STEWART. DOWNTOWN. AND THEN IN THE EARLY TWO THOUSANDS, THERE WERE SOME PROJECTS. BEING ACTIVELY PURSUED AND NEGOTIATED WITH, UM. RAIL AND IN PARTICULAR WITH AMTRAK, AND I THINK IT WAS IN 2005. AMTRAK ACTUALLY RAN A TEST LINE. FROM FLORIDA THROUGH STOPPED AND STEWART AND THEN WENT TO ST AUGUSTINE. BIG PRESENTATIONS IN SAINT AUGUSTINE AND THEN RETURNED EVERYBODY BACK AND STOPPED RIGHT HERE. IT'S SELFISH CIRCLE AND DROPPED EVERYBODY OFF ON THE PASSENGER RAIL. AND THERE WERE MANY PUBLIC HEARINGS HELD AT THAT TIME AND FOLLOWING THAT, AS IT RELATED TO FILLING THIS ROOM, EVERY SEAT IN THE ROOM AND PEOPLE IN THE HALL. TALKING ABOUT THE DESIRE AND WHAT MONEY SHOULD BE SPENT AND DONE TO RETURN AND RESTORE PASSENGER RAIL. AND THE RECESSION CAME AND OTHER REASONS FELL AND IT DIDN'T WORK OUT AS PLANNED. BUT THEN IN ROUGHLY 2013 OR 14, ALL ABOARD FLORIDA, CAME ON THE SCENE. AND UM. I KNOW THAT THERE WAS SOME PUBLIC COMMENT THAT WE DIDN'T DO ANY STUDIES, BUT THAT WAS THE FURTHEST FROM THE TRUTH. NOT ONLY WERE EXTENSIVE STUDIES DONE, BUT WE ALSO HAD AT LEAST FIVE PUBLIC WORKSHOPS. WE DID TOO EXTENSIVE SURVEYS. WHEN THE RESULTS CAME FROM ONE SURVEY. WE HAD A REVIEWED AND IT CAME OUT THAT EVEN THOUGH THERE WERE PEOPLE THAT WERE AGAINST THE IDEA OF HAVING TRAINS PASSED BACK THROUGH THE AREA, 65% OF THE PEOPLE SAID THEY DID WANT TO STATION UM MORE OF THE COMMISSIONERS AT THE TIME. THOUGHT THAT THEY, UH, SURVEY WASN'T PARTICULAR ENOUGH. AND SO WE RAN IT FOR ANOTHER SIX WEEKS. AND AGAIN 64, OR 65% OF THE PEOPLE AGAIN RESPONDED IN FAVOR OF WANTING A STATION AND THIS WAS WHEN WE WERE FILLING THE ROOM WITH PEOPLE SAYING THAT THEY DIDN'T WANT RIGHT LINE. UM, TO FILL THE TRACKS. THE CITY ALSO VOTED TO PASS RESOLUTIONS

UNANIMOUSLY. AND VOTED TO UPDATE ITS COMPREHEND COMPREHENSIVE PLAN ON TWO DIFFERENT OCCASIONS TO BE MORE SPECIFIC ABOUT HOW MUCH IT WANTED TO RESTORE PASSENGER RAIL TO THE CITY, AND AS A RESULT, THERE'S THREE DIFFERENT REFERENCES IN THE COP PLAN ABOUT HOW THE CITY SHOULD PRIORITIZE RETURNING PASSENGER RAIL. IN ADDITION TO THAT, UM, THERE WERE ENVIRONMENTAL IMPACT STUDIES THAT WERE DONE WHEN THE TRAINS WERE, UH, GOING TO EXPAND TO PASSENGER RAIL, EVEN THOUGH THE FREIGHT TRAINS ARE ALREADY MUCH GREATER IN WEIGHT AND MUCH HEAVIER AND CREATE MUCH MORE VIBRATION AND HAVE MUCH MORE IMPACT. THE FEDERAL AND STATE GOVERNMENTS STILL REQUIRED ALL OF THE ENVIRONMENTAL IMPACT STUDIES. WE DID STUDIES ON THE HISTORIC BUILDINGS IN DOWNTOWN STUART TO SEE WHAT WOULD HAPPEN WITH THE VIBRATIONS OF THEM. WE DID ENVIRONMENTAL IMPACT STUDIES ON THE IMPACTS OF THE BRIDGE AND THE TRAFFIC AND THE VIBRATION IN THE WATER AND THE MARINE INDUSTRY ASSOCIATION AND CAMERAS RELATED TO HOW MANY VOTES COULD PASS THROUGH WHEN THE BRIDGES WERE GOING THROUGH. AND STILL, THE PUBLIC SUPPORTED IT OVERWHELMINGLY. AND THEN, WHEN THERE WAS A BIG UPHEAVAL AGAINST THE IDEA OF BRIGHT LINE COMING THROUGH, WE HELD PUBLIC HEARINGS HERE, NOT AS A MEANS TO TAKE A POSITION ON IT ONE WAY OR THE OTHER BECAUSE THE CITY OF STEWART REALLY WASN'T INVOLVED IN ANY WAY WHATSOEVER. BUT THEY EVEN HELD A COUPLE OF MEETINGS AT THE LYRIC THEATER BECAUSE THIS ROOM WASN'T BIG ENOUGH, AND THEY NEEDED ROOMS THAT WERE 500 SEATS OR MORE. AND STILL THE VAST MAJORITY OF THE PUBLIC. SAID THAT WE ALREADY HAVE THE TRAIN COMING THROUGH OUR COMMUNITY. THE REASON OUR COMMUNITY EXISTS IS BECAUSE OF TRAIN STARTED US AND WAS IN THIS COMMUNITY IN LOW TIDE. IF YOU LOOK OUT BEHIND CITY HALL, YOU CAN ACTUALLY SEE THE STUMPS THAT STICK UP OUT OF THE WATER THAT ARE LEFT OVER FROM THE PLATFORMS WHEN THEY USED TO DO THE PINEAPPLES, AND THEY BRING THE PINEAPPLES OVER FROM RIAU AND LOAD THEM ONTO THE TRAINS TO BE SHIPPED. THROUGHOUT THE STATE. AND THEY'RE USED TO ALSO BE A HOTEL DOWN TOWARD FLAGLER PARK THAT WAS AGAIN A HOTEL THAT WAS IDENTIFIED AND LOCATED HERE BECAUSE OF THE FACT THAT THE TRAIN CAME TO OUR AREA. UM IN 2014, THE CITY COMMISSION AUTHORIZED THE CITY MANAGER TO NEGOTIATE WITH BRIGHT LINE. DURING WHICH UM, THE CITY MANAGER ACTUALLY WAS TRYING TO CONVINCE BRIGHT LINE TO PUT A STATION HERE BY OFFERING TO GIVE THEM THE LAND WHERE THE AZUL PROPERTY IS CURRENTLY LOCATED. AND ALSO CONTINUE TO MAKE CONTRIBUTIONS AND OTHERS AND AT THE TIME THERE WERE MORE FOCUSED ON JUST GETTING UP AND RUNNING AND DID NOT PURSUE THAT WITH US, BUT WE ALSO DIDN'T HAVE THE BENEFIT OF HAVING THE COUNTY ASSISTING AT THE TIME. AS IT MOVED FORWARD. I KNOW THAT IN 2014. THE CITY COMMISSION PASSED A RESOLUTION HAD A COUPLE OF PUBLIC HEARINGS IN 2016. WE HAD PUBLIC HEARINGS PASSED A RESOLUTION IN 2018 PASTORAL RESOLUTION. WE HAD PUBLIC HEARINGS WE MET WITH THE MARINE INDUSTRY ASSOCIATION, THE CITY MANAGER FILED A RESPONSE IN 2014 AND 2018 TO THE ENVIRONMENTAL IMPACT STUDIES. AND UM, ALSO ADDRESSED. THE RETURN OF PASSENGER RAIL AND THE CITY COMMISSION PASSED A RESOLUTION SUPPORTING BRIGHT LINE AND REQUESTING FUNDING AND FOR GRANT MONEY FOR THE PASSENGER RAIL. WE DID THE SAME THING AGAIN. EARLIER OR LATE 22 AND EARLY 23.

AND WHEN WE DID THOSE RESOLUTIONS, AND WE PUT THAT STUFF OUT, WE DIDN'T GET ANY.

UH, NEGATIVE FEEDBACK. NOBODY CALLED US AND SAID DON'T SEEK THE GRANTS DON'T SEEK THE DOUBLE TRACK BRIDGE. IN FACT, WE GOT BASICALLY SUPPORT FROM EVERY DIRECTION, TELLING US TO DO IT AND WE AND WE DID, AND IT'S UM MOVING FORWARD NOW. WE DIDN'T DO IT FOR THE BENEFIT. OF BRIGHT LINE. WE DID IT FOR THE BENEFIT OF OUR COMMUNITY SO THAT INSTEAD OF HAVING A BOTTLENECK HERE, WHERE THE TRAIN WOULD HAVE TO BE A SINGLE TRACK. IT WOULD ALLEVIATE THE NEED FOR STACKING FREIGHT TRAINS SO THAT OTHER TRAINS COULD PASS AND GO AND CAUSING INTERSECTIONS TO BE MORE. IMPACTED AND IT WOULD ALSO, UM ALLEVIATE THE NEED. OR IMPACTS ON THE MARINE INDUSTRY ASSOCIATION BECAUSE IT WOULD ALLOW FOR MORE BOAT TRAFFIC TO PASS UNDERNEATH THAT. UH, BRIDGE AND IN FACT I'M I'M AWARE THAT THE MARINE INDUSTRY ASSOCIATION AS WELL AS THE CHAMBERS OF COMMERCE, AS WELL AS OTHER, UM, BUSINESS DEVELOPMENT BOARD, THE ECONOMIC COUNCIL AND OTHERS HAVE ALL PASSED RESOLUTIONS. IN FAVOR OF AND ENCOURAGING THE COUNTY AND THE CITY TO JOINTLY PURSUE A STATION IN THE AREA. DURING PUBLIC COMMENT WHEN YOU HEARD THAT THERE WOULD BE NO STUDIES

OR NO SCIENTIFIC RESEARCH OR SOMETHING THAT THAT AGE OF THAT THAT'S THE FURTHEST FROM THE TRUTH THAT THE TRUTH IS THAT WE WILL FOLLOW THE CODE AND THAT THE STORMWATER WILL BE AT THE STORMWATER STANDARDS THAT WE HOLD HIGHER THAN REGULAR COMMUNITIES AND COUNTIES AND IT WILL MEET ALL OF THOSE STANDARDS AND THERE WILL BE PUBLIC HEARINGS. IT'S NOT A SITUATION WHERE IT WOULD JUST BE SOMETHING THAT HAPPENS. THE APPROVAL OF THE STRUCTURES ETCETERA WILL RETURN FOR PUBLIC HEARING JUST AS ANY BUILDING WOULD BE AND WOULD FOLLOW THE CODE AND WOULD MEET THE STORM WATER AND CAN MEET THOSE IMPACTS AND WILL BE PLANTED WITH ALL NATIVE PLANTINGS. AND WILL BE DESIGNED TO BENEFIT THE COMMUNITY. UM AND, UH, I DON'T THERE IS NO NEED TO DO. AT A IMPACT OF A WETLAND EVALUATION OR SOMETHING OF THAT NATURE BECAUSE IT'S CURRENTLY A PARKING LOT. AND THE HISTORY BEHIND THAT WAS THAT WHEN THE COUNTY BUILT THE COURTHOUSE THAT WAS GOING TO BE A DIFFERENT PARKING LOT CONFIGURATION IN THE CITY AND THE COUNTY WORKED TOGETHER BACK THEN. AND THE COUNTY, UM, GAVE THAT LAND TO THE CITY GAVE THAT LAND TO THE COUNTY TO PUT THE COURTHOUSE ON IN EXCHANGE FOR THE COUNTY, PUTTING GAZEBO PARKING ON EAST OCEAN BOULEVARD FOR THE GREEN SPACE. TIME I DON'T THINK ANYBODY REALIZED THAT IT WAS POLLUTED, BUT THE COUNTY CLEANED THAT UP AND THANK YOU FOR THAT. BUT EITHER WAY IT WAS AGAIN A JOINT VENTURE BETWEEN THE COUNTY AND THE CITY, AND IT WORKED OUT. BUT THE TRUTH IS THAT THE LOCATION THAT WE'RE DISCUSSING TONIGHT FOR THE INTER LOCAL AGREEMENT IS ONLY THE SITE BEHIND THE COURTHOUSE BECAUSE A CITY COMMISSIONERS UM, OUR PARTICIPATION IN THIS CAN ONLY HAPPEN IF IT'S WITHIN THE GEOGRAPHIC LIMITATIONS OF THE CITY AND THE SITE THAT WAS BROUGHT UP AS A RELATED TO THE AIRPORT OR THE FAIRGROUNDS IS OUTSIDE THE CITY'S GEOGRAPHIC TERMS, SO WE COULDN'T PARTICIPATE. BUT WHAT WE'RE ASKING YOU TONIGHT IS TO APPROVE AN INTER LOCAL AGREEMENT BETWEEN THE CITY AND THE COUNTY. AND GOING BACK TO 2014. WHEN THE CITY WAS MOVING FORWARD AND TRYING TO GET A STATION IN 2014. WE WEREN'T GONNA WE WERE GOING TO PURSUE IT WITHOUT ANY BENEFITS AT ALL FROM THE COUNTY OR CONTRIBUTIONS FROM THE COUNTY AT ALL, AND INSTEAD WE WERE GOING TO BE ALL IN EITHER WAY. FORTUNATELY FOR US, THIS INTER LOCAL AGREEMENT SERVES MORE THAN ONE PURPOSE. EVERYONE THE COUNTY'S AGREED TO WORK WITH US TO DO THE APPLICATIONS AND TO DO THE JOINT SUBMITTAL FOR THE RESPONSE TO THE RFP. NUMBER TWO IS PART OF THE INNER LOCAL AGREEMENT. THE COUNTY WOULD AGREE TO DEED TO US THE PARKING LOT. THAT'S ON THE WEST SIDE OF FLAGLER AVENUE DIRECTLY BEHIND THE COURTHOUSE. THAT'S A LITTLE OVER TWO ACRES THAT WOULD BE USED FOR THE STATION AND PARKING GARAGE. AND THEN WE COULD NEGOTIATE AND USE THAT FOR THE PURPOSES OF WORKING WITH BRIGHT LINE TO INSTALL THAT IN THAT LOCATION. BASED ON THE RFP THAT WAS PUT OUT BY BRIGHT LINE. THE RFP RESTRICTED ANY STATION FROM BEING NORTH OF CONFUSION, CORNER AND AS A RESULT WITHOUT THE COUNTY'S CONTRIBUTION OF THAT LAND, THE CITY REALLY WASN'T IN A POSITION TO BE ABLE TO RESPOND TO OR PARTICIPATING IN THE BID.

SO THAT BECOMES A CRITICAL PIECE OF THE PUZZLE. UM THE OTHER THING, IRONICALLY, IS, REGARDLESS OF THAT LAND OR NOT THE CITY'S COMPREHENSIVE PLAN ACTUALLY SAID. PROOF THAT IT WOULD RECORD WOULD WISH THE RESTORATION OF, UH, TRAIN STATION. IN THE CITY AND ITS POLICY TO 8 10.2. OR I'M SORRY. UM TO A 10.3. AND IT ACTUALLY IN THE LAST SENTENCE, SAID, PREFERABLY ON FLAGLER AVENUE BETWEEN EAST OCEAN BOULEVARD AND MARTIN LUTHER KING BOULEVARD BOULEVARD. AND IRONICALLY, THAT IS EXACTLY WHERE IT IS. AND WE WEREN'T THE OWNERS OF THE LAND WHEN THAT WAS WRITTEN, BUT AGAIN. THIS FULFILLS THAT ASPECT OF THE COMPREHENSIVE PLAN. WHAT THE TERMS ESSENTIALLY THAT WE'RE ASKING YOU TO VOTE ON WITH THE INTER LOCAL OF THE COUNTY IS THAT WE AGREE THAT THEY WOULD TRANSFER THE LAND TO US IN EXCHANGE FOR THAT THE CITY WOULD AGREE TO MAINTAIN AND PROVIDE 54 PARKING SPACES AVAILABLE FOR PUBLIC USE WITHIN A 0.25 MILE RADIUS OF THE COURTHOUSE. AND I PULLED UP THE UM, DESIGN THAT, UH, PAUL NICOLETTI DID IN LIKE 2015, OR 16. WHEN THERE WAS THE OR NO, ACTUALLY, 2008 OR NINE WHEN IT WAS THE TRANSIT CENTER.

BACK IN THAT LOCATION. WHEN THEY WERE TRYING TO BUILD A TRAIN STATION THERE AS WELL. AND ONE OF THE THINGS THAT SHOWED IN THE DESIGN WAS 85 DIAGONAL PARKING SPACES ON THE STATEMENT STREET

THAT WAS BETWEEN THE CITY WATER PLANT AND THE BASEBALL FIELDS THERE. AND I THINK WHAT I WOULD DO IS LOOK WITH BUILT AND WORK WITH STAFF TO TRY AND IMPLEMENT THOSE 85 ADDITIONAL PARKING SPACES JUST TO PROVIDE MORE THAN THE 54 BUT TO HAVE IT DIRECTLY RIGHT THERE IN THE LOCATION. IN ADDITION TO THAT, UH, PURSUANT TO AN AGREEMENT THAT THE COUNTY HAD ENTERED INTO IN 2018 WHEN THEY TWO WENT THROUGH EXTENSIVE. INVESTIGATION AS IT RELATES TO TRAINS, FEASIBILITY LITIGATION, ETCETERA. THE SETTLEMENT AGREEMENT THEY ENTERED ON ENTERED INTO AGREE THAT THEY WOULD PAY UP TO 50% OF THE CONSTRUCTION OF A TRAIN STATION. CONDITIONED UPON THAT TRAIN STATION, ENDING UP IN MARTIN COUNTY. THE COUNTY HAS AGREED TO HONOR THAT 50% OBLIGATIONS. SO AS PART OF THIS IN THE LOCAL AGREEMENT, THEY'RE AGREEING THAT THEY'LL CONTINUE TO MAKE THAT CONTRIBUTION. AND THEN ON TOP OF THAT THE CITY OF STEWART WOULD MAKE THE CONTRIBUTION OF A PARKING GARAGE NOW, IRONICALLY, THE PARKING GARAGE AGAIN, THE CITY WOULD HAVE STEWART IN 2014 WOULD HAVE BUILT IT AS PART OF THE TRAIN STATION TO FULFILL THE TRAIN STATION REQUEST. BUT FOR THE LAST FIVE OR SIX YEARS, EVERY ANNUAL WORKSHOP THAT WE HAVE WE HEAR THAT WE NEED A PARKING GARAGE AND DOWNTOWN STUART SO THE C R A AS WELL AS THE REGULAR CITY COMMISSION HAS ALWAYS HAD A PARKING GARAGE ON ITS LONG TERM PLAN AS WELL AND THIS WOULD GIVE US AN OPPORTUNITY TO GET THE PARKING GARAGE DONE AND MEET THE TRAIN STATION. UH, COMPREHENSIVE PLAN REQUEST. AND PROVIDE THAT PARKING GARAGE IN DOWNTOWN STUART. THE RFP. REQUIRES A CERTAIN AMOUNT OF SPACES. BUT IN TALKING WITH TREASURY, THIS REGIONAL PLANNING COUNCIL, THE DESIGN THAT WE'RE TRYING TO PUT THE TRAIN STATION OR THE PARKING GARAGE AND WOULD BE LARGER THAN THE MINIMUM AND OUT SO THAT WHEN THERE'S AN ARTS FESTIVAL, THERE'S OTHER EVENTS IN DOWNTOWN STUART. WE WOULD ACTUALLY HAVE THE PARKING GARAGE AVAILABLE FOR CAPACITY AND THOSE OF YOU TONIGHT THAT COMMENTED ON THE UM CHRISTMAS TREE LIGHTING THERE HAD TO BE 5000 PEOPLE THERE. I MEAN, I TOOK A PICTURE AT ABOUT SEVEN O'CLOCK AFTER IT WAS OVER. AND LITERALLY. IT LOOKED LIKE THERE WAS A CONCERT GOING ON, AND THERE WAS NOWHERE THAT THERE WASN'T PEOPLE. AND SO TO HAVE THAT PARKING AND EXCESS CAPACITY WOULD BE GREAT FOR THE CITY. IN ANY EVENT, THE INTER LOCAL AGREEMENT FINALLY HAS THE COUNTY AND THE CITY AGREED TO COOPERATE AND APPLYING FOR FEDERAL, STATE AND OTHER GRANTS TO OFFSET THE COST OF THE PROJECT. AND IF THEY'RE SUCCESSFUL IN OBTAINING THESE GRANT FUNDS FOR THE PROJECTS, THE FUNDS WILL BE DISTRIBUTED. BASICALLY PRO RATA, BASED UPON THE PURPOSE OF THE FUNDS AND THE PURPOSE OF THE GRANTS TO REIMBURSE BOTH THE COUNTY AND THE CITY AND BRIGHT LINE FOR ANY CONTRIBUTIONS THAT THEY MAKE TOWARD THE PROJECT ON AN EQUAL BASIS SO THAT WE ALL GET OUR EQUITABLE SHARE BACK. UM CAN I ASK A QUICK QUESTION? THERE WAS A NUMBER ONE IN THE NUMBER TWO ON THOSE IS THAT JUST FOR PURPOSES OF DISTINCTION WITHIN THAT PARAGRAPH OR IS THAT A RATING OF WHAT WOULD BE WEIGHTED MORE HEAVILY TRAIN STATION HAS NUMBER ONE THE PARKING GARAGE. THE FUNDS WILL BE DISTRIBUTED AS FOLLOWS. SO IF YOU THINK ABOUT THE PROJECT IF, IN FACT WE APPLIED FOR A CHRISTIE GRANT FOR THE PROJECT, AND IT INCLUDED THE STATION, AND IT INCLUDED THE UH, PARKING GARAGE.
